When does Prop. 64 in operation so we can smoke?

As voters go to the polls to decide the fate of recreational marijuana use in California, stoners across the state wonder — when can we legally smoke weed? If the proposal is adopted, when will these measures come into effect and will we have another? Medical Marijuana ID Card buy and consume cannabis?

In general, the California state proposals (those with numbers, such as “Prop. 64”) go into effect immediately after the election — at midnight on Nov. 9. But in reality, the results are not official until each of the 58 counties in the state sends their certified election results to the secretary of state. So a good mood on Prop. 64 may delay your long-awaited legal smoking cessation.

But if Prop. 64 pass, when will the components take effect?

When can we start smoking weed?

You will be able to immediately possess and smoke an ounce of marijuana as a Prop. 64 succeeds.

Smoking marijuana in public will still be illegal, just as it technically is now. But you may have noticed that this is not strongly enforced in San Francisco.

Do I still need a card to buy from a pharmacy?

Unfortunately, yes you will. Pharmacies are licensed to sell medical marijuana – no recreational marijuana. They will not be able to sell recreational marijuana to uncarded “patients” until the state has issued recreational sales permits. “Sales for adult use would begin January 1, 2018, subject to local government license,” according to CA NORML.

Can you buy and smoke weed if you are not a California resident?

All “persons 21 or older” will be able to use recreational marijuana according to the text of prop. 64. This also includes foreigners.

But pharmacies will still only sell to Californians with a doctor’s advice until they are licensed to sell recreational cannabis in 2018. So some weed tourists may be unhappy campers for the next year.

Will my corner shop start selling marijuana?

New. Recreational cannabis should not be sold where tobacco or alcohol is sold.

When can I legally own a marijuana plant?

Immediately after passage of Prop. 64! You can own up to six marijuana plants, but you can’t keep them out in the open.

Your plants must be “closed and not visible from a public place” according to the text of Proposition 64.
